Plebiscite Vote – Cannabis Control Law

NOTICE OF PLEBISCITE VOTE

VOTING DATE: NOVEMBER 16, 2019

TO: ALL MEMBERS OF THE MOHAWKS OF THE BAY OF QUINTE

TAKE NOTICE that a Plebiscite Vote will be held on November 16, 2019, to determine whether the Eligible Voters of the Mohawks of the Bay of Quinte First Nation agree that the Tyendinaga Mohawk Cannabis Control Law (“Cannabis Control Law”) and the Cannabis Control Board shall regulate all cannabis business activity in Tyendinaga Mohawk Territory.

The Plebiscite Vote will take place on November 16, 2019 at the Mohawk Administration Office located at 24 Meadow Drive, Tyendinaga Mohawk Territory from 9:00 a.m to 6:00 p,m.

Electronic Voting is also available and will commence October 28, 2019. For information about how to vote electronically, visit https://onefeather.ca/nations/mbq-tmt or see the attached educational materials regarding One Feather.

Mail in ballots will also be accepted. These ballots may be requested up until November 1, 2019 from Lawrence Lewis, One Feather at lawrence@onefeather.ca or 250-889-1582 and must be received by November 15, 2019.

Eligible Voters

For the purposes of the plebiscite vote, Eligible Voters are those members of the Mohawks of the Bay of Quinte who, on November 16, 2019, are 18 years of age or older, registered on the Band List, and are not disqualified from voting at Band elections.

Eligible Voters may vote only once either in-person at the polling station, or through electronic voting, or through a mail in ballot. A Voters List is posted at the Mohawk Administration Office.

Cannabis Control Law Information

Copies of the Cannabis Control Law can be picked up from the Mohawk Administration Office starting on October 15, 2019. Copies of the Cannabis Control Law can also be mailed to members on request. For a copy of the Cannabis Control Law to be mailed to you, please contact Charlotte Gurnsey at 613-396-3424 ext. 155 or by email at consultation@mbq-tmt.org .

MBQ legal counsel will be participate in community meetings/open houses, and will also be available by phone and email at 416-981-9354 or smainville@oktlaw.com to community members who wish to receive specific legal information regarding the proposed Cannabis Control Law prior to the plebiscite vote.

Effect of the PLEBISCITE vote

The proposed Cannabis Law will be considered accepted by the community if a majority of the individuals who vote, vote in favour of the proposed Tyendinaga Mohawk Cannabis Control Law (a bare majority, that is, fifty (50) percent of voters plus one vote).

If the proposed Tyendinaga Mohawk Cannabis Control Law is not accepted by the community, another community meeting may be held to discuss the community’s concerns with the law and a second vote may be scheduled.

If a bare majority of the individuals who vote do not vote to accept the proposed Tyendinaga Mohawk Cannabis Control Law at a second vote, the community will be considered to have rejected the law.

Please answer yes if you agree with the statement below, or no if you disagree.

The Cannabis Control Board and the Cannabis Control Law shall regulate all cannabis business activity in Tyendinaga Mohawk Territory through licencing and other control mechanisms set out in the Law.
